Terms of Service

Core terms for Clearfile administrative services and software products.

1. Scope of services

Clearfile Correspondence provides administrative correspondence management, document organisation, file-management software support and related record-keeping services as agreed in writing.

2. Excluded services

Clearfile does not provide legal advice, financial advice, debt counselling, debt adjusting, debt-management plans, insolvency advice, claims-management services or regulated professional advice. Clearfile does not handle client funds.

3. Debt correspondence administration

Debt-related correspondence support is charged per active debt, creditor account or reference. The service is limited to administrative correspondence support, record keeping, document organisation, deadline tracking and administrative response preparation.

4. No guarantee of outcome

Clearfile cannot guarantee that any creditor, lender, debt collector, solicitor, enforcement agent, ombudsman, regulator, court or third party will agree to pause, reduce, write off, refund, settle, close or otherwise resolve any debt, complaint, account or matter.

5. Client responsibility

The client remains responsible for the underlying debt, account, agreement, court documents, payment decisions, settlement decisions, complaint decisions, deadlines and any legal or financial consequences arising from the matter.

6. Software services

Software products are built to the agreed scope. Backup and rollback are included as standard where files may be renamed, moved or reorganised. The client must review previews, test outputs and keep independent backups of important data.

7. Liability limits

Clearfile is responsible only for providing the services expressly agreed in writing. Clearfile is not liable for creditor decisions, enforcement action, interest, charges, defaults, credit-file reporting, court action, missed payments, rejected complaints, rejected settlements, third-party refusal to engage, client-supplied errors or unauthorised changes made outside the agreed service.

Nothing in these terms excludes or restricts liability where it would be unlawful to do so, including liability for fraud, deliberate misconduct, or death or personal injury caused by negligence.

8. Authority and consent

Clearfile may require a signed authority and consent form before communicating with third parties or processing documents for a client.

9. Payment

Payment terms are stated on the relevant quote, invoice, Stripe Payment Link or written agreement. Bespoke work may require a paid requirements review and deposit before development starts.
